Thank you for choosing us! This Agreement (“Terms”) governs the use of all products and services provided by Hostimul (“Company”, “We”, “Our”). By ordering or using a service, the Customer is deemed to have fully agreed to these terms.
1. Classification of Services and Management Responsibility
Hostimul provides the following types of services tailored to various needs:
- Hosting Services (Shared, WordPress, Premium, Web, Email Hosting): Server infrastructure, network stability, and core software are managed by Hostimul. The Customer is solely responsible for their website content, internal applications, and email correspondence.
- VPS and Dedicated Servers: Full administrative (root) access is provided to the Customer. Internal server security, software installation, updates, firewall configurations, access control, and internal data protection are entirely the Customer’s responsibility.
- Domains, SSL, Titan Mail, Licenses, and IP Addresses: These are digital assets, and their usage is subject to the rules of both Hostimul and the respective international third-party vendors.
2. Third-Party Services and Management Intervention
- Hostimul may provide domain registration, SSL certificates, Titan Mail, licenses, dedicated IPs, and other add-ons.
- As some of these services are provided by third-party providers, their operational rules, technical limitations, and refund policies may be subject to the terms of those providers.
- In VPS and Dedicated server services, Hostimul does not intervene in internal management. However, Hostimul reserves the right to temporarily restrict or intervene if network security risks, abuse complaints, illegal activities, or excessive network loads are detected.
- Hostimul is not directly liable for global outages caused by third-party infrastructure.
3. Account Security and Identification
The Customer must maintain the confidentiality of account credentials. Hostimul reserves the right to request identification documents for risk management or legal requirements.
4. Acceptable Use Policy (AUP)
The following activities are strictly prohibited and may result in service suspension:
- Spam and bulk unsolicited emails.
- Phishing, malware, and distribution of harmful software.
- Hosting illegal, pornographic, or law-violating content.
- DDoS attacks, port scanning, and network abuse.
- Use of Proxy, Torrent, IRC, or services posing high network risks.
- Excessive resource usage affecting the service quality of other customers.
5. Backup and Data Protection
Data backup is the primary responsibility of the Customer.
- Hosting: Hostimul may take backups for internal security, but this service is not guaranteed. Integrity and availability are not warranted.
- VPS: Backups are not included in standard packages and require a separate paid subscription.
- Dedicated Servers: Hostimul does not store backups for dedicated servers; data protection is the Customer’s responsibility.
- Hostimul is not liable for data loss resulting from lack of backups.
6. Payment Terms
Services are provided on a prepaid basis.
- Accepted methods: Visa/Mastercard, PayPal, Bank Transfer.
- Account credit top-ups are non-refundable and can only be used for future services.
- Setup fees may apply to certain dedicated servers. Bank commissions are the Customer’s responsibility.
7. Refund Policy
- Refunds are only available for the initial order of Hosting services within 30 days.
- Non-refundable services: VPS, Dedicated Servers, Domains, SSL, Titan Mail, Licenses, Dedicated IPs, and account credits.
- Accounts suspended due to policy violations are not eligible for refunds.
8. Payment Delays and Cancellation
- Service may be suspended 1 day after the payment due date.
- Hosting accounts are kept for 30 days before deletion. VPS and Dedicated server data are kept for 7–14 days before permanent deletion due to resource constraints.
9. Abuse and Security Notifications
A 24–48 hour response window is typically given for abuse complaints. If network security is at risk, services may be restricted immediately.
10. Network Availability (Uptime)
Hostimul targets 99.99% network stability. This is a target and does not constitute an SLA guarantee.
11. Limitation of Liability
Hostimul is not liable for indirect damages. Financial liability is limited to the amount paid during the last billing cycle.
12. Jurisdiction
This Agreement is governed by the laws of the Republic of Azerbaijan.
13. Updates to Terms
Hostimul may update these terms at any time. Updates are effective upon publication.
